the rules for using folio.

1. About these terms

These terms of service ("Terms") govern your use of folio, a portfolio tracking app for trading card game collectors, provided by FOLIOTCG LTD (company registration number SC885042, registered in Scotland), referred to in these Terms as "we", "us", or "folio".

By creating an account, joining our waitlist, or using folio in any way, you agree to these Terms. If you don't agree, please don't use folio.

2. Who can use folio

You must be at least 13 years old to use folio. If you're between 13 and 17, you should use folio with the knowledge and permission of a parent or guardian.

You must provide accurate information when signing up. You're responsible for maintaining the security of your account and for all activity under your account.

3. Your account

Keep your password confidential. Don't share your account with anyone. If you suspect unauthorized access, change your password and contact us immediately at hello@foliotcg.com.

You can delete your account at any time. When you do, we'll delete your personal data as described in our privacy policy.

4. Acceptable use

When using folio, you agree NOT to:

• Use the service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to accounts, data, or systems
• Interfere with or disrupt the service, servers, or networks
• Use automated means (bots, scrapers, etc.) to access folio without our permission
• Impersonate another person or misrepresent your identity
• Harass, threaten, or harm other users
• Upload content that is illegal, infringing, defamatory, or misleading
• Attempt to reverse engineer, decompile, or extract our source code
• Resell, sublicense, or redistribute access to folio without our written permission

We may suspend or terminate accounts that violate these rules, without refund or notice where appropriate.

5. Your content

When you add cards to your collection, upload scan images, or create trade lists, you keep full ownership of that content. However, by using folio, you grant us a limited licence to store, display, and process your content as needed to operate the service.

If you use trading or social features that make content visible to other users (such as public trade lists or shared wishlists), you're responsible for what you share. We reserve the right to remove content that violates these Terms or that we consider harmful, illegal, or inappropriate.

For scan images specifically: we may use them to improve our card identification systems over time, as described in our privacy policy. We don't publish your scans or share them publicly.

6. Price data and valuations

folio displays estimated market prices for cards, sourced from third-party data providers (such as Cardmarket and eBay) and, in future, from first-party sales on folio itself.

These prices are estimates and are not guarantees. Actual sale prices depend on many factors including card condition, grading, buyer demand, seller reputation, platform fees, and timing. folio's valuations should not be treated as financial advice, professional appraisals, or guaranteed resale values.

Important caveats about the data we display:

• Trend prices on Cardmarket and similar sources blend sales of cards in different conditions and grading tiers. A single high-grade sale (for example, a PSA 10 or graded copy) can temporarily distort the displayed average for a card you own ungraded. Always check the actual condition and grade context before relying on a number.
• Price movement data ("movers", trending cards, price history charts) is descriptive of past activity, not predictive of future prices. Past performance does not indicate future value.
• Some cards in our catalogue have limited or partial pricing data. We work to improve coverage but cannot guarantee completeness or accuracy for every card at any given time.
• Currency conversion (e.g. EUR to GBP) uses live exchange rates that fluctuate; numbers can change between page loads.

You use our price data at your own risk. We are not responsible for any financial decisions you make based on information shown in folio. Always verify current prices through your intended buyer, seller, or marketplace before any transaction.

7. Trading and transactions

folio currently facilitates the discovery of trades between users but does not process or handle any transactions. If you trade or sell cards with another user through folio, the transaction itself happens between you and the other user, outside of folio. We are not a party to those transactions.

We are not responsible for disputes, fraud, losses, or any issues arising from trades between users. We recommend using safe practices when meeting other collectors: meet in public places, use tracked postage, and verify cards before exchanging money.

If we add payment processing or in-app transactions in the future, these Terms will be updated accordingly.

8. Service availability

We aim to keep folio available and working reliably, but we can't guarantee uninterrupted access. The service may occasionally be unavailable due to maintenance, updates, technical issues, or circumstances outside our control.

We reserve the right to modify, suspend, or discontinue any part of folio at any time, with or without notice. Where reasonable, we'll give advance notice of major changes or discontinuation.

9. Our intellectual property

folio, including the app, website, logo, branding, design, and underlying software, is owned by FOLIOTCG LTD and protected by copyright, trademark, and other laws.

You may use folio for its intended purpose of tracking your personal card collection. You may not copy, modify, distribute, or create derivative works based on folio without our written permission.

Card names, game names, images, and related intellectual property belong to their respective owners (such as The Pokémon Company, Wizards of the Coast, Konami, Bandai, and others). folio displays this information for the purpose of identifying and cataloguing cards in your collection.

10. Third-party services

folio integrates with third-party services for specific features (such as card identification via Ximilar, or price data from Cardmarket and eBay). These services have their own terms and privacy policies, which apply to your use of those features.

We are not responsible for the availability, content, or practices of third-party services.

11. Disclaimers and liability

folio is provided on an "as is" and "as available" basis. To the maximum extent permitted by UK law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that folio will be uninterrupted, error-free, secure against all threats, or that pricing data will be fully accurate or complete.

To the maximum extent permitted by UK law, FOLIOTCG LTD will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of folio, including loss of data, loss of profits, or loss of collection value. Our total liability for any claim related to folio is limited to £100 or the amount you've paid us in the past 12 months, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

12. Termination

You can stop using folio and delete your account at any time.

We can suspend or terminate your access to folio if you violate these Terms, if we believe you're using the service fraudulently or harmfully, or if we discontinue the service. Where reasonable, we'll give you notice and an opportunity to resolve the issue.

Sections of these Terms that should reasonably survive termination (such as intellectual property, liability, and dispute resolution) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll notify you by email or through the app before the changes take effect. The "last updated" date at the top always reflects the most recent version.

If you continue to use folio after changes take effect, you're agreeing to the updated Terms. If you don't agree, you should stop using folio and delete your account.

14. Governing law and disputes

These Terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

If you're a consumer based outside Scotland, nothing in this section affects your rights to bring proceedings in the country where you live under applicable consumer protection laws.
